Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period during which the consumer may exercise the right of withdrawal;
Consumer: the natural person who is not acting for purposes relating to trade, business, craft or profession and who enters into a distance contract with the entrepreneur;
Day: calendar day;
Durable medium: any instrument that enables the consumer or the entrepreneur to store information addressed personally to them in a way accessible for future reference and unchanged reproduction;
Right of withdrawal: the possibility for the consumer to dissolve the distance contract within the cooling-off period;
Model withdrawal form: the model withdrawal form made available by the entrepreneur;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract concluded within the framework of an organised system for distance selling;
Means of distance communication: a means that can be used for concluding a contract without the simultaneous physical presence of the consumer and the entrepreneur;
General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

The text of these General Terms and Conditions is made available to the consumer before the conclusion of the contract.

If, in addition to these General Terms and Conditions, specific product or service conditions apply, the consumer may invoke the provision that is most favourable to them in the event of conflicting terms.

If any provision of these General Terms and Conditions is wholly or partially void or annulled, the remaining provisions shall remain in full force and effect.

Where these General Terms and Conditions do not provide, the applicable statutory provisions shall apply.

Any ambiguities in these General Terms and Conditions shall be interpreted in favour of the consumer.
Article 4 – The Offer

The offer contains a complete and accurate description of the products and/or services.

Images are a truthful representation as accurately as possible. Minor deviations may occur, provided they are not material.

Obvious mistakes or errors do not bind the entrepreneur.

Each offer includes clear information about:

the price including taxes;
-
any shipping costs;
-
the method of payment, delivery and performance;
-
the right of withdrawal;
-
the validity period of the offer.

Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer.

In the case of electronic acceptance, the entrepreneur shall promptly confirm receipt.
-
The entrepreneur takes appropriate security measures for electronic transactions.

Each agreement is concluded subject to sufficient availability of the products.
Article 6 – Right of Withdrawal

The consumer may withdraw from the agreement without giving any reason within 14 days after receipt of the product.

During the cooling-off period, the consumer may only use the product to the extent necessary to establish its nature, characteristics and functioning.

Withdrawal may be effected using the model withdrawal form or in any other unequivocal manner.
-
After withdrawal, the product must be returned within 14 days.

The consumer must be able to demonstrate that the product was returned in time.
Article 7 – Costs in Case of Withdrawal

The costs of returning the product shall be borne by the consumer.

The entrepreneur shall refund all payments received, including standard delivery costs, within 14 days after withdrawal, after:

the product has been received, or
-
the consumer has provided proof of return.

Any reduction in value resulting from use beyond what is permitted may be charged to the consumer.
Article 8 – Exclusion of the Right of Withdrawal

The consumer is requested to return the product, where reasonably possible, in its original condition and packaging.

The right of withdrawal may not be refused solely because the packaging has been opened.

A reduction in value may be applied if the product has been used more than necessary.
Article 9 – The Price

All prices include VAT.

Printing and typographical errors are reserved; no rights may be derived from such errors.
Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products comply with the agreement and reasonable expectations.

The consumer is entitled to a product that complies with what may reasonably be expected for a reasonable period of time. redelijke termijn voldoet aan wat hij mocht verwachten.

Any manufacturer’s warranty does not affect statutory rights.

Complaints regarding defects must be reported within two months after discovery.
Article 11 – Delivery and Performance

Delivery shall take place within 30 days, unless otherwise agreed.

In the event of delay, the consumer may dissolve the agreement free of charge.

The risk of damage or loss remains with the entrepreneur until delivery.
Article 12 – Payment

Payment shall be made using the payment methods offered.
-
Delivery shall take place only after payment has been received.
-
In the event of non-payment, reasonable costs may be charged.
Article 13 – Complaints Procedure

Complaints must be submitted within 2 months after they are identified.

The entrepreneur will respond within 14 days.

If no solution is reached, the consumer may submit the dispute via the European ODR platform:

Article 14 – Disputes
-
Dutch law shall apply to all agreements.
-
This choice of law does not affect mandatory consumer protection laws of the country in which the consumer resides.
-
The Vienna Convention on Contracts for the International Sale of Goods does not apply.
Article 15 – Additional Provisions
Additional or deviating provisions may not be to the detriment of the consumer and must be made available on a durable medium.
